(a) to (c): One case relating to the Gujarat riots has been handed over to the CBI. Details of the case are as under:
Limkheda Police Station (District-Dahod) Crime Register No. 59/2002, investigated by local police and tried by JMFC, Limkheda and closed accepting the `A` final report, was handed over to CBI and registered as case No.R.C.1/S/2004-Mum in the CBI SCB on 1.1.2004 under orders dated 16.12.2003 of the Hon`ble Supreme Court of India in Criminal Writ Petition No. 118/2003 and Criminal Misc. Petition No. 8850/2003. Investigation of the case has already been concluded and charge-sheet has been filed by the CBI on 19.4.2004. The case is pending trial.

(a): As per information made available by the State Government of Gujarat, 254 Hindus and 790 Muslim (including those killed in Police firing) were killed in the post Godhra riots of 2002.
(b): As per available information 223 persons have been reported missing, 2548 persons sustained injuries, 919 persons were rendered widows and 606 children were orphaned during the riots.
(c): The rates of compensation paid by the State Government of Gujarat are as under: An amount of Rs 1.5 lakhs has been paid as ex-gratia to the next of kin of each person killed.
In the case of those injured the rates of payment to each individual are as under: Rs.5,000 each to those with upto 10% disability; Rs.15,000 each to those with 10% to 30 % disability; Rs.25,000 each to those with 30% to 40% disability; Rs.50,000 each to those with more than 40% disability and permanent incapacitation.
In addition, relief has been extended by the State Government to the victims of the riots under the following heads:
i) Cash doles and assistance for house-hold kits;
ii) Food grains to Below Poverty Line families in riot affected areas;
iii) Housing Assistance;
iv) Rebuilding earning assets;
v) Rehabilitation of Small business;
vi) Assistance to Industries/shops and hotels;
vii) Interest subsidy on loans to affected units;
viii) Insurance paid to the affected; ix) Rehabilitation of orphaned children and widows; x) Integrated Child Development Scheme services to riot affected children, pregnant and lactating mothers;
xi) Widows` Pension, etc. The State Government has further informed that a total expenditure of Rs. 204.62 crores has been incurred towards relief and rehabilitation measures.
(d) : The State Government has informed that they have published the data as recommended by NHRC.

Shah as Member to inquire into the `facts, circumstances and the cause of events` of incidents of burning of Sabarmati Express train and subsequent incidents of violence in the State. The role of any organization in the recent communal riots in Gujarat is also under enquiry by the Commission.

(a) to (c): National Human Rights Commission (NHRC) in its final report, has observed that there was a failure on the part of the State Government to control the situation. The State Government has, however, not agreed with the above observation and has stated that effective steps were taken to bring the situation under control. The National Minorities Commission has only suggested various steps that should be taken by the Government of Gujarat to provide relief to those affected by the communal riots.
(d): It is the primary responsibility of the State Government to maintain public order and peace. The Government of India shares intelligence and sends advisories/alert messages to the States/UTs from time to time and also makes available Central Para Military Forces to them on specific request. A special force called the Rapid Action Force is deployed to deal exclusively with the communal tensions. Assistance is also provided to the State Governments for modernization of their policing infrastructure.

STATEMENT REFERRED TO IN REPLY TO RAJYA SABHA STARRED QUESTION NO.253 FOR ANSWER ON 20.3.2002 REGARDING COMMUNAL RIOTS IN GUJARAT
(a)&(b): As on 14.3.2002, 91243 inmates have taken shelter in 96 relief camps.
(c): 673 persons were killed and 1269 persons sustained injuries in the communal violence in Gujarat which began on 27.2.2002. Besides 5326 houses, 3751 shops, 1831 cabins and 1448 vehicles were burnt and 891 shops were damaged during the said incidents in Gujarat. However, no major riots involving huge loss of life and property have been reported from other parts of the country except some sporadic incidents in a few States, which were promptly tackled by the concerned State Governments.
(d): The following emergency relief measures were announced/taken by the Government of Gujarat:
(i) Death compensation to the next of kin of the deceased: @ Rs. One Lakh.
(ii) Injury assistance: From Rs.2000/- to Rs.50,000/- depending on percentages of disability.
(iii) Cash assistance Rs.15/- per day per person (maximum 5 persons) for 15 days.
(iv) Assistance for household kits: Rs.1250/- per family.
(v) Assistance for earning assets to hand-cart pullers, larigalla wallas etc.: Rs.10,000/-.
(vi) Housing: Rs. 5,000/- to Rs.50,000/- depending on damage suffered.
(vii) Assistance to Relief Camps:
The State Government has played pro-active role to support relief camps run by the Non Governmental Organisations and essential commodities per day per head are being supplied as per the following norms:-
Wheat Flour: 400 grams, Rice: 100 Grams, Oil, Sugar, Dal, Milk powder: @ 50 grams each. Rs.5/- per person per day for miscellaneous expenditure.

(b): The observations of the Banerjee Committee report are as under :-
(i) The fire on Sabarmati Express on 27th February, 2002 cannot but be ascribed to be an accidental fire which engulfed the coir, the foam and the latex available on berths coupled with the luggage of the passengers causing thereby the smell of burning and thereafter dense smoke culminating into leaping flames and not a deliberate attempted event.
(ii) There has been a preponderance of evidence that the fire in coach No.S6 originated in the coach itself without any external input.
(iii) The question of any miscreant activity does not and cannot arise.
(iv) All is not well with Railway Safety as they should be in their approach in order to avoid any further untoward incident like the present one.
(v) There has been failure on the part of the Commission of Railway Safety and Railway Administration to conduct a statutory inquiry into this accident.
(vi) The response of Godhra Fire Brigade was not unsatisfactory.
(vii)Failure of Government Railway Police has also been adversely commented.
(viii)Role of Railway Administration has been adversely commented for :-
(a) Not making any concerted efforts to preserve clues of the incidents.
(b) Not giving due importance to this railway accident as this was considered to be a miscreant activity by Railway Administration without any inquiry.
(c) Discrepancies in record keeping.
(d) Not following up the specified practices at the time of railway accident like certification of track and coach fitness.
(e) Failure of Railway Protection Force (RPF).
(f) No individual has been held responsible for the incident.
No Action Taken Report has been prepared in view of this report being interim in nature.
